    I applied for 485/EAD/AP in the month of June'2007.
    I got the receipt and my finger printing is done.
    Now my EAD/AP?485 are in pending approval stage.

    At this time, I need to travel out of country for urgent reasons,

    how it will work.

    I have H1B stamped on my passport which is valid till March'2010.

    Is it OK to travel on this H1B and re-enter or as my finger printing is done, I am already on AOS status.
    Please help.

    I came to US on H4, 3 years ago. Later I took my H1B with a recruiter and got it with I-94. It was valid up to 2007 oct. But I couldn't take up any work due to some problems. Recently I went to India and came back. At the port of entry I got new I-94 with H4 stamping. Means My H1 Is not valid now ? In this case, is there any way to apply for change of status again as my H1 is valid up to 2007. Or else do I need to apply for my new H1B again ? Pl. any one clarify.

    You can extend apply for AP (Advance Parole) ;-) at anytime provided you have your 485 pending so there should be no "risks"

    only risk i see is that what if you have to travel and for some reason your H1 stamping gets delayed (if you have a AP you will be safe there)

    Also their processing times keep on fluctuating - what if you later down the road are
    in need of AP apply for one and then dont get it approved by the time you want to travel

    Personally I prefer to just keep things simple and apply for AP renewals even though
    I wont use them - just so that there is no "divergence" from the norm
    Just so when USCIS officer is processing your case they wont have to think or
    issue query to get clarification etc etc

    As the title suggest, it is meant for folks who have invoked AC21 (1-140 approved, I-485 filed & pending more than 6 months, job desc almost similar) successfully and unsuccessfully.

    If you have successfully transferred, can you comment on the experience, any denial notices that you had to overcome? Have you got the green card finally?

    If unsuccessful, what issues are you facing? Is there some work around or going back to desh is the only option?

    I heard that GC is for a future position. If this is the case, can labor, I-140 and I-485 be filed for a person and this person join the company after labor, I-140 and I-485 have been approved? The person will join the same position mentioned in the labor cert with salary >= the labor petition.

    I have met with staffers from offices of both MD senators a few times (in their DC offices) and I have been to the DC office of my local Congress woman.

    While on H1B with Employer A, can I use EAD for 2nd job with Employer B?

    Also, can I work as independent consultant/contractor (get 1099 instead of W2) while working on H1B with Employer A?

    Thank you for the response.
    The salary on Labor is mentioned as $76k. At the time of renewing EAD and AP every year it is at $90k. Since, salary increased after filing GC within the same company.
    With AP portability a lot of advisors say, salary shouldnt be a concern rather job duties are.

    On EAD you can work multiple jobs, accept payment or stocks or compensation from any employer.

    By the way, in H1B you can accept "profit on passive investment".

    Alright so it is better then i dont take any equity at all untill i get greencard?

    what if i come on EAD ?? does it effect anything or still the same result ??

    I am a nurse from the Philippines currently living in northern California, enrolled in university, working towards my masters degree. I currently have a F1 student visa, have already passed the NCLEX and also hold a Philippines RN license. I don't have any work experience as a nurse besides my clinical experience as a student. I wanted to know what my current options are? I have a company willing to sponsor me on the east coast. I was referred to them by my sister-in-law who is currently working for them. I spoke to the companies recruiter but she couldn't answer some of my more detailed immigration questions.

    I just wanted to get some options from some helpful members here. I currently have an appointment with an immigration lawyer next week but wanted to be somewhat inform on my options before meeting with the lawyer.

    I know their is a long wait currently for nurses coming from the Philippines. Does it make my situation a little easier considering I am already in the US on a F1 visa? I was told that if they were to lift retrogression for nurses that I would be process asap because I am currently living in the US legally... I seriously have my doubts about this lol.

    Any insight on my current situation is much appreciate.

    A lot of nursing jobs dont need a 4 yr bachelor's degree and thats why you cant use
    H1B for that unless the specialised nursing jobs needs a bachelors.
    Therefore (thankfully) Nurses are directly applied for Green Card EB3. However there
    is significant backlog even for ROW EB3. There is lobby effort to allocate green card quota for nurses like they did in 2004.
    The employer (with the lawyer help) will file I140 for you and when the PD is current you can file I485.
    But since you are on F1 visa, filing I140 you might have problem with the non immigrant intent clause at the
    port of entry.

    Let me start my saying that H-1B status and H-1B visa are, somewhat related, but two different things.

    If you are currently in the US on H-1B status, and your H-1B status is about to expire, then your employer needs to file a I-129 petition for extension, with a new LCA, to the USCIS. You can do premium processing, and have the response from the USCIS in 15 calender days.

    Once you have the approval notice of your extension, you can go to your home country, or Canada or Mexico, and apply for a new H-1B visa.

    Though it is your employer's application, you are legally allowed to pay the $1000 for premium processing.
    Some posts suggest that it is entirely your employer's headache, but to be honest, it really doesn't work that way, especially if you work for a small company that is not very well versed with the process.

    Hello everyone,
    My driver's license has come up for renewal in Feb 2009. I have 2 yrs EAD.I have send my H1 for renewal but it has not got yet approved..
    My employer suggessted that I use my EAD card to get my license renewed. In Ideal case I would like to use my approved H1 to renew my license. However since its taking time for my H1 renewal can I use my EAD card to get my license renewed.

    Hi:

    I am currently using EAD. My I-485 is pending status. I am planning to get married in India soon. She will be in India as I can not bring her on H4 and student visa is difficult. So dilemma is about 485 name addition. Can I add spouse's name in I-485 application whenever Priority Date is current?

    If yes, then how does it work? I mean is it possible at all?

    As long as you get married before your I-485 is approved, you can file a 'follow-to-join' petition for your spouse when your priority date becomes current. You will need to submit I-824 when your PD becomes current. Your spouse will obtain an immigrant visa overseas after the petition is approved.
    You may contact an immigration attorney if you cannot file this on your own and require help.

    Sorry not the answer you are looking for but I remember them scanning the bar code and A# was on screen - cant remember it it was manually entered or popped up due to bar code scan...
